residence requirement, 3 years reference period and new job

Thank you again for all the help you are providing.

I'd like to understand the law concerning residence requirement a bit more.
I've lived in Denmark for 3 years, 8 months. So, I don't meet the new residency requirement.

I became unemployed on 1st of July 2018.
Starting 1st May 2019, I am employed again.

Having read the QA here, I understood the following (correct me if I wrong):

I will be able to go unemployed until 1st of July 2021 (three years Ifrom first time becoming unemployed). In other words, I could work till Mid-May 2021 (and then I could get the unemployment benefits for the remaining time left for this 2 years). Despite the fact that I'll earn is roughly 3818 hours.

Hi,

if you already are in a 2-year period with unemployment benefits (which must be used within a 3-year reference-period), and this was approved before January 1, 2019, then you can get dagpenge for all the 2-year period, also if you have work during the period and therefore will not be receiving dagpenge during one/sevaral periods during the 2-year. Work will mean that the 2 year period will be extended, but it is still the same period, and you have the right to receive dagpenge, because it was initial approved before Januar 1, 2019.

If you have to earn a new 2-year period with dagpenge (requires that you work 1.924 hours during the last 3 years), then you must meet the residence requirement.

I am not sure if I fully understood you though.


1. So, what you are saying is that the moment when I reach 1924 hours (essentially a year of working) the new period will start automatically for me/
2. Or If I am employed now for 2 years (till may 2021) I could still be given unemployment benefits since originally I started receiving them in July 2019 and stopped in April 2019 and have some time left… or?

within the 3-year period, which is called the reference-period, you can switch between receiving dagpenge, and working/earning wage.
Every time you use 1 hour of dagpenge, it will be deducted from the 3.848 hours/2 year.

While you work the 3-year period is still running in the background.
If you don't use the full 2-year period (3.848 hours) with dagpenge within a 3-year period (reference period), then you will lose the rest of the 3.848 hours.

And if you after that apply for dagpenge again, then the A-kasse will look at how many hours you have worked within the last 3 years. And only if you have got registered at least 1.924 working hours (since the start date of your last 2-year dagpenge period), then you can get a new 2-year period with dagpenge.

The new period don't start automatically - its only if you apply for dagpenge again after the first period with dagpenge is used/or expired (the 3 year period).

I am sorry for so many questions! Just trying to get the best of my understanding on what to do next.

So essentially, if I work full-time from May 2019 after a year of full-time work (1.924 hours) May 2020, if I go unemployed, a new reference period will commence?

Or is it like no matter how many hours I work for, I have 3 years from the date my first unemployment benefits period started? And after that date, I would be able to receive any?

as I understand your previous comments, then you started on a 2-year dagpenge period on 1st of July 2018. If this was your first-time unemployment period, then the dagpenge right was earned either by fulfilling the income-requirement or as a graduate.
You have until July 1, 2021 to use 3.848 hours with dagpenge. As long as you have hours (from the 3.848) left, your A-kasse will not look at all on how much you you have worked since July 1, 2018.

However working hours can be used to extend the 2-year period. 1 day of work gives you 2 days more with dagpenge. You can maximum extend with 1 year, so will have dagpenge for 3 years.
If you by this way extend your dagpenge period, then also the reference-period will be extended (1 day of work exends the reference period by 3 days). However you can maximum extend the reference-period by 1,5 year, so it will be 4,5 years.

The total maximum benefit period can thus be 3 years (corresponding to a total of 5,772 hours) within a period of 4 years and 6 months (corresponding to a total of 54 months).

Only if you want a second 2-year period with dagpenge, then the A-kasse will look on how many hours you have registered since July 1, 2018.
Because this will not be a first-time unemployment period, then you need to meet the working-requirement (instead of the income-requirement). Therefore the A-kasse will look if you have worked at least 1.924 hours. If you have, then you will get a new 2-year period, that must be used within a new 3-year reference period.
