Aktivering in jobcenter

Hello,
I have been assigned to "Aktivering" course from jobcenter, which should last 13 weeks, nevertheless I would like to try my luck back in my home country and it everywhere says that I am allowed to take the benefits for 3 months to any country in EU. The problem is, that the jobcenter says I cannot leave due to the course and that I can look for a job in my home country, but have to be present in the course every day - which does not really make sense. Could you please advise me, if there is any way how I could leave Denmark and still have benefits for finding a job elsewhere.

I do not think, they cannot let me move out if I do not want to attend the course and look for a job in Denmark. I pay my a-kasse membership for a while, so I do not understand this issue.

Thank you for your response.

Hi,

if you are an EU/EEA-citizen you can take the unemployment benefits with you for up to 3 months, if you go to another EU/EEA-country and look for a job.

We have a detailed article about conditions for doing this:https://a-kasser.dk/transferring-unemployment-benefits/.

It looks like for us that you meet all the requirements for being able to having dagpenge while searching for job in your home/EU-country.

However, you also tell us that the Jobcenter already have made a "Jobplan" for you ("Min plan") about 13 weeks of education. Normally - and hopefully - this have been done in cooperation with you.

And the problem for you is that when this "Min plan" have been made you must attend to the activity (in your case a course). If you do not, then you will be regarded by your A-kasse as not avalaible for the labour market. And therefor you will lose your right to receive dagpenge. If its first time you will get a quarantine. If you are regarded as "not availabe for the labour market" several times, you may lose your right to recive dagpenge completely.

Only if you find a job, or the Jobcenter find a job for you, then you can quit the activity.

However, "Min plan" must be revised if this is justified by the person's situation or if there are significant changes in the labor market conditions. This is stated in the legislation about this, and you could try to mention this for the Jobcenter/your A-kasse.

You find the relevant law ("Bekendtgørelse af lov om en aktiv beskæftigelsesindsats") here:                            https://www.retsinformation.dk/Forms/R0710.aspx?id=184891#idaa703eb0-9528-4d31-9095-1c930056b54f. The relevant paragraph about revision of "Min Plan" can be found ih §27, paragraph 7.

But we do not think that your situation - i.e. you wish to go to another country to look for job, is enough to have the plan revised now.

But we will recommend you to try to convince the Jobcenter that there will be a good chance for you to find a job in your home country.

You can also start applying for jobs now, and if you are invited by a company/employer to a job-interview in your hone-country, then you are allowed to go to the jobinterview.

Hope this helps you.

Best regards,
