Question with respect to the new A-kasse rule

My spouse and I have been in Denmark since September, 2014 and September, 2013 respectively. Both of us are working currently and are members of A-kasse. I would like to know if we are eligible for unemployment benefit in and after 2019 as per the new rule.

Hi,

the new law will be phased in over three years, so the requirement in 2019 will be that you must have stayed 5 out of the last 12 years in Denmark.

So depending on what time you arrived to Denmark in 2014 it seems that both of you in 2019 will have stayed at least 5 years in Denmark. You dont tell us whether your are EU-citizens or not. If you are EU-citizens then also periods with stay in other EU/EEA-countries can be included.

Both of us were in India before coming to Denmark.
Based on your answer it seems I’m satisfying the criterion, but for my spouse it becomes 4 year and 4 months on 1st January, 2019. Just to confirm, does it mean she won’t be getting nemployment benefit, if needed, before 2022?

for your spouse it can be a little complicated, because as mentioned in our article concerning the new rule, the rule will be phased in over 3 years. So if she apply for benefits in 2019 she must have stayed in DK for 5 out of the last 12 years. If she apply for benefits in 2020 she must have stayed 6 out of the last 12 years, and if she apply in 2021 and beyond, she must have stayed 7 out of the last 12 years.

You must meet the requirement on the day you apply for unemployment benefits.

If you spouse apply for benefits in 2019, and do that before 1. of september 2019, she will not meet the requirement. If she apply in the period from sept. 1 - dec. 31 2019, she will fulfill the requirement.

And the same calculation can be made if she apply in 2020. In 2020 she will have stayed 1 more year, but at the same time the requirement is 1 more year.

But from 1. of september 2021 and beyond she will always have stayed in Denmark more than 7 of the last 12 years. And therefore from 1. of september 2021, there should be no problem.
