Hej,
I am planning to move to United Kingdom. I am member of A kasse and under full time employment from last 10 years.
I am Danish national. I excercized my treaty rights before brexit and got pre settlement status in UK, means i can work and live in UK for next 5 years until January 2026.I am member of A kasse and have been employed in Denmark from last 10 years and would like to know if I can get means if i can get dagpenge from my danish A-kasse for 3 months in uk on basis of PDU2 while job searching there?
Can I take a kasse benefits in UK while searching for job?
Your kind advice/suggestions in this regard would be highly appreciated.

answering of your question – if you can get dagpenge during 3 months job-search in UK (PD U2) depend on whether you are covered by the EU/UK withdrawal Agreement or not.
Persons covered by the EU/UK withdrawal Agreement will keep rights aquired before December 31, 2020. This also includes the right to have dagpenge under jobsearch in UK.
However its out of the scope of our Website to answer if you are covered by the EU/UK withdrawal Agreement. As I read this only applies to citizens who have been covered by the EU rules regarding free movement before the end of the transitional period. In other words:
- Union citizens who exercised their right to reside/lived in the United Kingdom in accordance with Union law before December 31, 2020 and continue to reside there thereafter
- United Kingdom nationals who exercised their right to reside in one of the 27 Member States (for example DK) in accordance with Union law before December 31, 2020 and continue to reside there thereafter.
As mentioned this is out of the scope for us to answer, but I think you are NOT covered by the EU/UK withdrawal Agreement, and therefor do not have right to get dagpenge during jobsearch in UK.

8. april 2021 kl. 14:02 #170Bruger2021DeltagerHej Muhammad, Jeg kan oplyse dig, at du ikke har ret til PDU2 fra Danmark til Storbritannien og derfor ikke kan søge om EØS-dagpenge ved arbejdssøgning i England. Dansker/dansk statsborger, der ikke har udnyttet retten til fri bevægelighed inden udløb af overgangsperioden for Brexit, har ikke ret til en PDU2 til Storbritannien i en periode, der starter efter årsskiftet 2020. Den danske statsborger har ikke ret til at arbejde og opholde sig i Storbritannien. Hilsen Københavns A-kasse
I got above answer from my A kasse. But as i understand this is for those who has not excercized their treaty rights before brexit deadline.
In my case, i did and got permission to live and work in uk until 05 January, 2026. Besides this i have retained all other rights like national health care etc. That’s why I am planning to go there for job search.
Maybe i need to send my A kasse letter i got from UK home office explaining my rights.

as mentioned before its out of the scope for us to guide about status according to “Withdrawal agreement”.
But as I see it: You have not traveled into UK before December 31, 2020, and therefor you are not covered. As The European Union writes (see link above):
The Withdrawal Agreement protects those EU citizens lawfully residing in the United Kingdom, and UK nationals lawfully residing in one of the 27 EU Member States at the end of the transition period.
Its, after my opinion, not enough that you have got pre settlement status in UK.

That what i am trying to prove that i have been to uk before 31 December that’s why I have been granted limited leave to remain on 4 January,2021 for next 5 years.
If you read my attached document, it clearly states that i have secured my status according to withdrawal agreement and can enjoy the benefits as it was before 31/12/2020.
Only those eu citizens who traveled and stayed even just for 24 hours before 31/12/2020 were entitled to secure their rights and thus got pre settlement status.
Even more, if eu citizens traveled before 31 December they just need to prove residence of 24 hours in last six months and deadline to apply is 30th June, 2021.

if you think you are covered by the withdrawal agreement (I can not guide about that…) then you have the right to 3 months job-search in UK.
In that case I will recommend you to send a complain to your A-kasse. The A-kasse are obliged to send your complain to star.dk. The Public Authority responsible for A-kasser in Denmark).

I am pretty sure now after all the discussion and especially after reading on your website that i am entitled to 3 months dagpenge in UK even efter 1st January,2021 as i traveled to uk before 31 December and secured my status.
But EU settlement status letter from the Uk home office is in english, i have emailed it to my A-kasse but i don’t know if they will understand my point of view.
I will wait for a-kasse answer and would contact STAR.DK in case.
I am again thankful for your patience and timely cooperation in this case.
